What is sexual assault?

Sexual harassment is unwanted behavior of a sexual nature that offends, humiliates, or intimidates an individual. It includes sexual advances, as well as verbal, nonverbal, or physical harassment, in workplaces, educational institutions, or other settings.

Sexual harassment and sexual violence are distinct from one another.

Sexual violence is an act defined by the Criminal Code, and those who commit it are subject to criminal liability. It involves any form of sexual act or behavior against a person’s will or any action that violates a person’s sexuality.

Sexual harassment, on the other hand, is not classified as a crime. It is generally addressed through civil or disciplinary measures.


Sexual harassment in the workplace

In the workplace, sexual harassment is regulated by the Labor Code of the Republic of Armenia.

Sexual harassment in the workplace or other work-related environments (including business trips) refers to any unwanted sexual act, whether physical, verbal, or nonverbal, that influences a person’s work-related decisions or creates a degrading or hostile work environment. This can include acts that result in social isolation or damage an individual's dignity.

An example of sexual harassment would be directly or indirectly demanding sexual favors in exchange for professional advancement, a salary increase, or a bonus.

An employee who has experienced violence or sexual harassment at work is entitled to annual leave upon request, regardless of their length of service.

In cases of sexual harassment at work, your first point of contact should be Human Resources or your direct supervisor.

If you are prepared to stand up for your rights, taking legal action can help restore your dignity and address the situation. However, it is essential to gather appropriate evidence to support your case. This may include photographs, audio recordings, video footage, and witness statements.
